Terms of Service for Maple Grove Garden Works

1. Introduction and Acceptance of Terms
These Terms of Service (the “Terms”) govern the provision of services by Maple Grove Garden Works (“Maple Grove Garden Works,” “we,” “us,” or “our”) to any customer, client, visitor, or user (“you” or “your”). By requesting, scheduling, paying for, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our services. These Terms apply to all services provided by Maple Grove Garden Works, including any estimates, proposals, work orders, invoices, service agreements, and communications related to our services.
2. Scope of Services
Maple Grove Garden Works provides residential and commercial garden and landscape services, which may include:
- Garden design and planning
- Lawn care and edging
- Planting and shrub installation
- Seasonal cleanups
- Mulching and soil improvement
- Irrigation system checks
- Pruning and hedge trimming
The exact scope, schedule, materials, and deliverables for each project will be set out in a written estimate, proposal, service order, invoice, or other written confirmation issued by Maple Grove Garden Works. Any work not expressly included may be treated as extra work and may require additional charges and scheduling.
We may decline, suspend, or modify services where site conditions, weather, safety concerns, access limitations, legal restrictions, or other circumstances make performance impractical or unsafe.
3. User Obligations and Responsibilities
You agree to:
- Provide accurate, complete, and current information when requesting services.
- Ensure safe, reasonable, and timely access to the property and work areas.
- Disclose known hazards, including underground utilities, irrigation lines, pet hazards, unstable structures, pests, or contaminated soil.
- Obtain any required permissions, permits, approvals, or consents from landlords, condominium corporations, municipalities, or other third parties.
- Remove or secure personal property, valuables, fragile items, and obstacles from work areas before service begins.
- Ensure pets, children, and other persons are kept away from active work zones.
- Comply with all applicable laws, bylaws, and property rules relating to the services.
You are responsible for confirming that plants, materials, and service recommendations are suitable for your site conditions, including sunlight, drainage, soil type, climate, and maintenance expectations. We are not responsible for outcomes caused by inaccurate information, hidden site conditions, or your failure to follow our care instructions.
4. Payment Terms and Conditions
Unless otherwise agreed in writing, fees are due in accordance with the invoice or estimate provided by Maple Grove Garden Works. We may require a deposit before scheduling or commencing work, particularly for larger projects, custom orders, or material purchases.
- All prices are stated in Canadian dollars unless otherwise indicated.
- Applicable taxes, including GST/HST, will be added where required by law.
- Material costs, disposal fees, delivery charges, and special equipment costs may be billed separately.
- Invoices are payable by the due date stated on the invoice or, if no due date is stated, within 14 days of issuance.
- Late payments may result in interest charges at the maximum rate permitted by applicable law, as well as suspension of services.
If a payment is reversed, declined, charged back, or otherwise disputed without valid cause, you may be responsible for any associated bank, processing, collection, or administrative fees to the extent permitted by law.
5. Cancellation and Refund Policy
Cancellations or rescheduling requests should be made as early as possible. For scheduled services, we may require reasonable notice, which may vary depending on the nature and timing of the work.
- If you cancel after materials have been ordered, those materials may be non-refundable and you may be charged for them.
- If you cancel after work has begun, you will be responsible for payment for services performed, materials used, and any non-recoverable costs incurred.
- Missed appointments due to lack of access, inaccurate instructions, or failure to prepare the site may be treated as late cancellations and may be subject to a fee.
- Refunds, if any, are issued at our discretion only where required by law or where Maple Grove Garden Works agrees in writing that a refund is appropriate.
Because garden and landscape services are affected by weather, seasonality, plant health, and site conditions, completed services are generally non-refundable except where required by applicable consumer protection law.
6. Liability Limitations
To the fullest extent permitted by applicable law, Maple Grove Garden Works shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of enjoyment, loss of use, or loss of business opportunity, arising out of or related to the services.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services shall not exceed the amount paid by you to Maple Grove Garden Works for the specific service giving rise to the claim.
We are not responsible for:
- Pre-existing damage, hidden defects, or latent site conditions.
- Damage caused by underground utilities, irrigation systems, buried objects, or inaccurate site information.
- Plant failure due to weather, disease, pests, improper watering, soil conditions, or lack of maintenance after installation.
- Delays or non-performance caused by weather, supply shortages, access issues, or events beyond our control.
- Loss or damage to items left in work areas unless caused by our proven gross negligence or wilful misconduct, where liability cannot be excluded by law.
Nothing in these Terms excludes or limits any liability that cannot be excluded under applicable Canadian law, including liability for fraud, wilful misconduct, or any non-excludable consumer rights.
7. Intellectual Property Rights
All content created by Maple Grove Garden Works, including proposals, designs, drawings, plans, photographs, written materials, and other deliverables, remains our property or the property of our licensors unless otherwise agreed in writing.
Upon full payment, you are granted a limited, non-exclusive, non-transferable license to use the deliverables solely for the intended project and for your personal or internal business use, as applicable. You may not reproduce, distribute, modify, sell, or use our materials for other projects without our prior written consent.
We may, unless you object in writing, photograph completed work for portfolio, marketing, insurance, or recordkeeping purposes, provided that we do not disclose personal information in a manner contrary to applicable privacy laws.
8. Data Protection and Privacy
Maple Grove Garden Works collects, uses, stores, and discloses personal information only as necessary to provide services, process payments, communicate with you, maintain business records, comply with legal obligations, and improve our operations.
We take reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, loss, misuse, or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
We may share personal information with trusted service providers, such as payment processors, accounting services, scheduling tools, or subcontractors, only to the extent reasonably necessary to perform services or support our business operations.
Where applicable, our handling of personal information will be governed by Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy laws. You may contact us to request access to or correction of your personal information, subject to legal restrictions.
9. Force Majeure
Maple Grove Garden Works shall not be liable for any delay or failure to perform caused by events beyond our reasonable control, including but not limited to severe weather, storms, flooding, fire, labour disruptions, supply shortages, transportation interruptions, power outages, acts of God, epidemics, public health emergencies, governmental actions, or utility failures.
In such circumstances, we may reschedule, suspend, or modify services as reasonably necessary. If a force majeure event materially affects performance, we will make commercially reasonable efforts to communicate with you and propose an alternative date or solution.
10. Changes to Terms
Maple Grove Garden Works may update or revise these Terms from time to time to reflect changes in our services, business practices, or applicable law. The updated Terms will be effective when posted or otherwise communicated to you, unless a later effective date is stated.
Your continued use of our services after any change becomes effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you should stop using our services and, where applicable, notify us of your objection before the next scheduled service.
11. Applicable Law and Jurisdiction
These Terms and any dispute arising out of or relating to them, the services, or any related transaction shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Subject to any mandatory consumer protection or other non-waivable legal rights, the parties agree that the courts located in Toronto, Ontario shall have exclusive jurisdiction and venue over any dispute arising from or related to these Terms or the services.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or other competent authority, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
If any invalid or unenforceable provision can be modified to make it valid and enforceable while preserving its intent, the provision shall be interpreted and enforced as modified to the fullest extent permitted by law.
These Terms constitute the entire agreement between you and Maple Grove Garden Works regarding the subject matter herein, unless supplemented by a separate written agreement signed by both parties.
